Terms and Conditions

Last Updated: October 12, 2026 | Version 1.21 | Takes effect November 12, 2026

1. Acceptance of Terms

Beyond Payday is operated by HTMLGuy LLC, doing business as Beyond Payday (formerly PiggySize; "Beyond Payday," "we," "our," or "us").

By accessing and using Beyond Payday, you accept and agree to be bound by these terms. If you do not agree to these terms, please do not use our service.

Please read Section 22. It explains how disputes are handled: first we try to work it out together, and if that fails, disputes go to binding individual arbitration instead of court, with no class actions. You can opt out of arbitration within 30 days (see Section 22.10). Sections 4, 19 and 20 explain that Beyond Payday's figures are estimates, not advice, and limit what we owe if something goes wrong.

2. Eligibility & Age Requirements

Age Requirement: You must be at least 13 years old to create an account. Children under 13 may use Kid Mode only when a parent or legal guardian sets it up and consents. Public lessons are open to everyone. By creating an account, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have obtained parental or guardian consent to use this service.

Minors and parents: If you are 13 to 17, you may use Beyond Payday only through a family account set up by your parent or legal guardian. Your parent or guardian accepts these Terms for you, agrees to them on their own behalf, and is responsible for your use of the service. Where the law allows, Section 22 applies to claims you or your parent brings about your use of the service. Children under 13 never accept these Terms. Kid Mode is set up by a parent under Section 8 and our kids' privacy notice.

United States: Beyond Payday is designed for households in the United States, and new account registration is currently limited to the United States.

We reserve the right to terminate accounts that we believe are created by or for users under 13 years of age without parental consent, or that violate these eligibility requirements.

3. Service Description

Beyond Payday is a personal financial tracking and planning tool designed to help you manage and visualize your finances. You enter your own financial information manually — we never ask for your bank credentials and never connect to your financial accounts. Beyond Payday does not hold or move money, process payments on your behalf (other than billing for Beyond Payday itself), or provide banking, brokerage, lending, tax, or credit services. We provide this service "as is" for your personal use, and we may add, change, or remove features over time as we improve the service.

Learning Center and certificates: Learning Center lessons, stories, games and quizzes are educational content. They teach how money works and are not financial, investment, tax, or legal advice. A lesson or track certificate shows that it was finished in the Learning Center. Quizzes are self-paced and checked in your browser, and a certificate is not a professional credential, license, or academic credit. A certificate's verify link is public: anyone who has the link can see the name on the certificate, what was finished, and the date. You can change the name on a certificate or remove it in Learn at any time.

4. Estimates, Not Advice

Estimates, not advice. Beyond Payday is a tracking and planning tool. Everything it shows is an estimate based on the information you or your family members enter, and on assumptions and outside data we use. This includes budgets, cash flow, net worth, take-home pay, tax figures, retirement and Social Security projections, debt payoff dates, insurance and coverage checks, scenarios, "what-if" plans, savings tips, Learning Center content, and answers from Beth or any connected AI app. Outside data includes things like tax tables, contribution limits, inflation and return assumptions, prices, and published averages. None of it is financial, investment, tax, insurance, or legal advice. We are not a financial adviser, broker, tax preparer, insurer, or law firm, and using Beyond Payday does not create that kind of relationship.

No guarantee of accuracy. We work to make our calculations correct, but software has bugs. Assumptions can be wrong or out of date, outside data can change, and the results depend on what was entered. Figures may be incomplete, rounded, simplified, delayed, miscategorized, or wrong. Imports and automatic sorting or categorizing may also misread your information. We do not promise that any figure, projection, import, or category is accurate, complete, or current, or that any result will happen.

Your decisions are yours. You decide what to do with your money. Before you act on anything you see in Beyond Payday, check the figures that matter against your own records and, where appropriate, ask a qualified professional. Examples are filing taxes, choosing when to claim Social Security, moving retirement money, buying insurance, or taking on or paying off debt. You are responsible for your decisions and their results.

5. Availability, Backups and Your Records

Availability. We work to keep Beyond Payday available, but we do not promise it will always be available, uninterrupted, fast, or free of errors. It may be unavailable or slow because of maintenance, updates, bugs, security events, high demand, or events outside our control. Those events include outages at our hosting, database, email, payment, AI, or network providers. We may change, suspend, or stop any feature.

Keep your own copies. Beyond Payday is not a backup service. It is not your official record of accounts, taxes, or legal documents. Data can be lost or corrupted despite our safeguards. To protect yourself:

  • download a copy of your family's records from Settings → Your Data regularly. We recommend at least once a month and before any big financial decision.
  • keep important records, such as statements, tax returns, insurance policies, and legal and estate documents, with their original source or in another system you control.
  • have another way to see key figures if Beyond Payday is unavailable when you need it.

Limits. To the maximum extent permitted by law, we are not responsible for losses caused by downtime, slowness, data loss, or data corruption, except as Section 20 allows.

6. Security & Data Breaches

Security Measures: We implement reasonable security measures to protect your data, including encryption and secure authentication. We also offer optional account-security features, such as two-factor authentication and one-time backup codes, which you can enable in Settings → Security. However, no system is completely secure.

Your Responsibility: You are responsible for maintaining the security of your account credentials. In the event of any security breach or unauthorized access, we will make reasonable efforts to notify you, but any limits on our responsibility for losses resulting from a security incident are subject to Section 20 and applicable law.

7. Privacy & Your Data

Your privacy is important to us. We collect and use your personal information in accordance with our Privacy Policy. You retain all rights to your financial data, and we will never sell it to third parties. You give us permission to store, copy, process, and display the information you and your family members enter, but only to run, secure, support, and improve the service for you, as our Privacy Policy describes. That permission ends when the data is deleted, except for the limited records described in Section 18 and our Privacy Policy. You can download a copy of the records your family has entered from Settings → Your Data. The account owner can delete the family account from Settings; deletion removes personal and financial data from our active databases. Limited records may remain as described in Section 18 and our Privacy Policy, and deletion cannot be undone.

8. Family Accounts

Roles: A Beyond Payday account is a family account. The person who creates the account is the owner; the owner may invite a spouse or partner and children as additional members. One subscription covers the whole family.

Sharing & Permissions: When you invite someone to your family account, they can view and edit your family's financial information according to the permissions set for them. The owner controls each member's permissions and may remove members at any time. Child members have limited access and see only information relating to them.

Children: You may add a child to your household only if you are their parent or legal guardian, and you agree that the birthdays you enter are accurate. Children under 13 may not have a Beyond Payday login. You are responsible for the information you record about your children, and you can edit or delete it at any time.

Kid Mode: A parent or legal guardian may set up Kid Mode for a child under 13 in the family, after reading our kids' privacy notice and giving consent. Kid Mode is for tracking and learning only: it records money you or your child keep somewhere else, and no real money moves in or out of Beyond Payday. Allowances, interest, bonuses, loans, and job pay in Kid Mode are amounts you choose to record and pay yourself; Beyond Payday does not pay or owe them. These are records you choose to keep. They are not accounts, deposits, or promises by Beyond Payday, and we are not responsible for any amount you choose to pay or not pay your child. You are responsible for your child's use of Kid Mode, for the devices you open or pair it on, and for keeping your grown-up PIN private. You can delete your child's Kid Mode data at any time in Settings → Family.

Support Access: Beyond Payday staff cannot view your household's financial figures unless the account owner approves a specific request. A named member of our team must ask, in writing and with a reason; only the owner may approve it; the owner sets how long it lasts, up to three days; and the owner may withdraw it at any time. Approved access ends automatically when the time runs out. We keep a record of every request, decision and use, and the owner can read it in Settings → Privacy. Refusing or withdrawing support access will not affect your account, your plan, or your right to support — though it may limit how much we can help with a problem we cannot see. This does not restrict access we are required to make by law, or that is necessary to investigate abuse, fraud, or a threat to someone's safety.

Responsibility: You are responsible for who you invite. Members must meet the age requirements in Section 2; children under 13 cannot have their own logins. The owner is responsible for the family account overall, including billing.

Owner Deletion: If the owner deletes the family account, the family's personal and financial data is deleted from our active databases, including data entered by other members. Limited records may remain as described in Section 18 and our Privacy Policy.

9. User Responsibilities

Account Security: You are responsible for maintaining the confidentiality of your sign-in credentials, including your password and any other sign-in methods you enable. You agree to accept responsibility for all activities that occur under your account.

Accurate Information: You agree to keep your account information (such as your email address) accurate so we can reach you about your account.

Lawful Use: You agree to use Beyond Payday only for lawful purposes and in accordance with these terms. You will not attempt to hack, probe, scrape, disrupt, reverse engineer, or compromise the security of our service, or attempt to access data belonging to other families.

Your information. You are responsible for the information you and the people you invite enter, import, or confirm. That includes changes you approve from Beth or a connected AI app. You are responsible for keeping it accurate and up to date, for having the right to enter information about other people, and for checking figures before relying on them.

Your records and backups. You are responsible for keeping your own copies of the records you need (see Section 5).

Your devices and connections. You are responsible for your devices, your internet connection, the browsers and apps you use, and any third-party app or AI assistant you connect to your account.

10. Free Trials & Subscriptions

Trial Grant: Upon creating an account, you will automatically receive a free trial of our Pro features (currently 30 days). No payment method is required for the trial. By signing up, you agree to participate in this trial period. Trial length and specific features are determined at the time of grant and may vary for special promotions. One free trial per family.

Subscribing During a Trial: You may subscribe to a paid plan at any time during a free trial, and you keep the days remaining on that trial. Your paid subscription is scheduled to begin on the date your trial was already set to end: you are not charged at checkout, your access continues without interruption, and your first payment is charged on that trial end date. If you cancel before then, you are not charged at all. (Where fewer than 48 hours remain on a trial, our payment processor requires the subscription to begin at least 48 hours after checkout, so the start date may fall slightly later than the original trial end date. Trial time is never shortened.) Because the trial is not cut short, no refund or credit for unused trial days is applicable.

Automatic Transition: Upon expiration of a free trial (if you have not subscribed to a paid plan), your family account will automatically transition to the "Free" plan. Each person is eligible for one free trial. We use the email address on the account to check this, so opening another account with the same email address (or a variation of it) after a trial has been used starts on the Free plan instead of a new trial. No charges will be incurred automatically at the end of a trial unless you have explicitly provided payment information for a subscription. If you choose to move to the Free plan while a trial is still running, that change also takes effect at the end of your trial period rather than immediately, so you keep the trial days you have left.

Payment Method: We use third-party payment processors (such as Stripe) to handle all subscription billing. By providing payment information, you authorize us to charge the applicable fees via our processor.

Price Changes: We may change subscription prices from time to time. New subscribers pay the price shown at checkout. If we lower the price of a plan, existing subscribers who pay more for the same plan and billing interval will pay the lower price starting with their next renewal. If we raise the price of a plan, your price will not go up while your Price Lock applies, and we will email you at least 60 days before a higher price takes effect. The higher price then applies from your first renewal on or after the later of the end of your Price Lock and the end of that 60-day notice period. If you do not agree to a new price, you can cancel before it takes effect.

Price Lock: The price of your paid subscription is locked for 3 years from the date of your first paid (non-trial) payment. The Price Lock covers the price only; features, limits and plan contents may still change as described in these terms. It lasts only while your paid subscription continues without a break. If you switch between monthly and annual billing, you keep your original lock date. While your Price Lock applies, or before a price increase we have told you about takes effect, switching will not raise your price: you pay the lowest of the current price, the price that applied when your lock began, and the equivalent of what you pay now. A pending increase keeps its original date. If your subscription ends (for example, you cancel and your paid period runs out, or it is canceled after failed payments) and you subscribe again later, you pay the price in effect at that time and a new 3-year Price Lock starts from that payment. The Price Lock is a guarantee to you. It is not an indication that prices will rise.

Failed Payments: If a subscription payment fails, our payment processor may retry the charge. If payment continues to fail, your subscription may be canceled and your family account moved to the Free plan. Your data is preserved.

Cancellations: You may cancel your subscription at any time through your account settings or the billing portal. Cancellations will take effect at the end of your current billing period.

Refunds: Except where required by law or as described under "Shutdown Refund" below, all payments are non-refundable, and you are not entitled to refunds or credits for partial subscription periods or unused features. We may, at our sole discretion, issue a full or partial refund, a courtesy credit, or free subscription time; doing so once does not entitle you or anyone else to the same again. If you switch between paid plans, we may apply prorated charges or credits for the remainder of your billing period.

Shutdown Refund: If we decide to permanently shut down the service, we will email you at least 90 days before the shutdown date. We will then refund the unused part of your current paid subscription period after the shutdown date, calculated in proportion to the time remaining, to your original payment method. The refund is based on the amount you actually paid for that period, less any amount already refunded. It does not apply to free trials, free or credited time, or periods that have already ended.

Events Beyond Our Control: The 90-day notice and Shutdown Refund above apply whenever we decide to shut down the service. If an event beyond our reasonable control (for example war, natural disaster, pandemic, government action, the loss of key personnel, or the failure of a critical service provider) prevents us from maintaining the service, we may instead automatically stop all subscription renewals so you are not charged again, and make the service read-only. We will email you how to download your data, and it will remain available to download for as long as we are able to keep the service online.

Notifications: We provide courtesy email notifications regarding your trial status (e.g., when a trial starts, is ending soon, or has expired). By signing up and participating in a trial, you consent to receive these transaction-related communications.

11. Promo Codes & Special Offers

Beyond Payday may, from time to time, offer promotional codes or special offers. These codes have no cash value and are non-transferable. Each code may be subject to specific terms (e.g., expiration date, one-time use, limited to new users). We reserve the right to modify, suspend, or terminate any promo code or offer at any time without notice. Use of a promo code constitutes acceptance of any additional terms specific to that offer.

12. AI-Powered Features

AI Assistant: Beyond Payday may offer AI-powered features, including but not limited to an AI financial assistant. These features use artificial intelligence to provide informational and educational responses based on your self-reported financial data.

Not Professional Advice: AI-generated responses are not financial, investment, tax, or legal advice. They are provided for informational and educational purposes only. You should always consult with qualified professionals before making financial decisions based on any AI-generated content.

Usage Limits: AI-powered features are subject to reasonable usage limits, which may vary by plan type and may change at any time without notice. We reserve the right to throttle, restrict, or modify access to AI features at our discretion to ensure service quality and availability for all users.

Accuracy: While we strive to provide helpful and accurate AI responses, AI-generated content may contain errors, inaccuracies, or outdated information. We make no guarantees about the accuracy, completeness, or reliability of AI-generated responses. You are solely responsible for verifying any information provided by AI features.

Changes Beth Proposes: If your household turns on Read & write for Beth, Beth may propose changes to your records. A change is made only when you confirm it, and you are responsible for reviewing each proposed change before you confirm it, just as for an edit you make yourself. Beth can make mistakes. Undo is offered for a limited time where available and is not guaranteed.

Connected AI apps. You may connect an outside AI app or assistant, such as ChatGPT or Claude, to your account through our connector. That app is not ours. Its own provider's terms and privacy policy apply to it. The connected app acts on your instructions and under your account:

  • anything it reads, says, or changes through the connector is treated as your own action.
  • if you give it Read & write access, it can create, change, or delete records without a separate confirmation in Beyond Payday.

You are responsible for choosing the app, for the access you grant, for reviewing what it does, and for disconnecting it (Settings → AI Connections) if you no longer want it to have access. AI apps can misread figures, make mistakes, or act in ways you did not intend. We are not responsible for what an outside AI app says or does, or for its provider's handling of data it receives. We may limit, suspend, or turn off the connector, or any single connection, at any time.

Data Usage: AI features may process your financial data to generate personalized responses. This processing may be performed by trusted third-party AI providers on our behalf and is governed by our Privacy Policy. Conversations with the AI assistant may be stored, and may be reviewed by our team, to improve service quality and for support and safety purposes. Your financial data is not used to train AI models.

13. Third-Party Professional Referrals

Beyond Payday may display contact information for third-party professionals such as financial advisors, insurance agents, accountants, and attorneys. These listings are provided for informational convenience only.

No Endorsement: Beyond Payday does not endorse, vet, certify, or guarantee the qualifications, competence, services, or advice of any listed professional. The inclusion of a professional on our platform does not constitute a recommendation or referral.

Independent Relationship: Any engagement with a listed professional is solely between you and that professional. Beyond Payday is not a party to, and accepts no responsibility or liability for, any services, advice, fees, or outcomes resulting from such engagements.

Your Responsibility: You are solely responsible for verifying credentials, licensing, insurance, and suitability before engaging any professional. We encourage you to perform your own due diligence and check with relevant licensing boards or professional organizations.

No Compensation: Unless explicitly stated otherwise, Beyond Payday does not receive compensation or commissions for displaying professional listings. If any referral relationship involves compensation in the future, it will be clearly disclosed.

Sharing with your financial professional. If you invite or allow a financial professional or firm to see your household's information through Beyond Payday, you choose what to share, and you can stop sharing at any time. The professional is not our employee or agent, and we have not checked their license or credentials. Their advice, services, fees, and conduct are theirs alone. Copies they download, and anything they do with your information outside Beyond Payday, are their responsibility. The same goes for anything they enter for you. Our liability for anything about this sharing is limited as Section 20 describes.

14. Partner Program

Beyond Payday offers a Partner Program that allows participants to earn rewards for referring new users. The Partner Program is governed by a separate Partner Agreement, which participants accept when signing up as a partner. These terms do not modify the Partner Agreement.

15. Use License & Feedback

Permission is granted to use Beyond Payday for personal, non-commercial purposes. This is a license, not a transfer of title. You may not modify, distribute, or create derivative works based on our service without express permission.

Feedback: If you send us feedback, suggestions, or ideas about the service, you agree that we may use them without restriction and without compensation to you.

Tools and calculators. The interactive calculators, tools, and widgets we make available through the Service (including those on our blog and our free tool pages) are provided free of charge for your personal use on Beyond Payday websites and applications, and on other websites only through our official embed code as described under "Embedding our calculators" below. They, together with the underlying code, formulas, calculations, and content, are the property of HTMLGuy LLC, doing business as Beyond Payday, and are protected by copyright and other laws. Except as allowed under "Embedding our calculators," you may not copy, reproduce, embed, frame, mirror, scrape, republish, distribute, sell, or otherwise use them on any other website, application, or service, or for any commercial purpose, without our prior written permission. Any results these tools produce are educational estimates only and are not financial, investment, tax, or legal advice.

Embedding our calculators. We grant you a limited, non-exclusive, non-transferable, revocable, royalty-free license to show our free calculators on your website using the official embed code provided on each calculator's page, as long as: (1) you use the embed code unmodified, and you do not copy, edit, host, or reuse the calculator code, formulas, or content yourself; (2) you keep the "by Beyond Payday" credit link that comes with the code visible and unchanged; (3) you do not imply that Beyond Payday endorses, sponsors, or is affiliated with you, your website, your products, or your advice; and (4) your website does not offer loans or debt settlement, or contain illegal, deceptive, or harmful content. You may embed the calculators on a website that earns money, such as one with advertising, but you may not sell or charge for access to the calculators themselves. Embedded calculators run on code we host, which we may update, change, or discontinue at any time. We may revoke this license for any website at any time, including by making the calculator stop working there. We keep all rights not expressly granted. Embedded calculators are provided "as is" under these Terms, and their results are educational estimates only, not financial, investment, tax, or legal advice, for you or your visitors. You are responsible for your website and for how you present the calculators on it. Because embedded calculators are free, we have no liability to you, or to anyone who visits your website, for any embedded calculator, to the maximum extent the law allows. That includes their results, errors, downtime, changes, removal, or effect on your website. Your only remedy if you are unhappy with an embedded calculator is to remove it. You will defend and indemnify Beyond Payday against claims arising from your website, your content, any advice or product you offer, how you present the calculators, or your breach of this license. Your visitors use the calculators as members of the public. Nothing about an embed creates a relationship between us and you or your visitors beyond this license. If you embed a calculator for an organization, you confirm you are authorized to accept this license for it.

16. Accessibility

We are committed to making Beyond Payday accessible and easy to use for everyone. We continuously work to improve the accessibility of our platform and strive to follow best practices for web accessibility. If you encounter any barriers or have suggestions for improvement, please contact us.

17. Changes to These Terms

Small changes. We may make changes that do not reduce your rights, such as clarifications, corrections, new features, or changes required by law. These take effect when we post them and update the "Last Updated" date.

Material changes. If a change materially reduces your rights or increases your obligations, we will tell you ahead of time:

  • we will notify you in the app, by email to your account address, or both, at least 30 days before it takes effect. Changes required by law or for security can take effect sooner.
  • we may ask you to accept the updated Terms in the app before you continue using the service.
  • if you do not agree, you can stop using Beyond Payday, cancel your subscription (Section 10), and delete your account before the change takes effect.
  • if you keep using the service after the effective date, or you accept in the app, you accept the updated Terms.

No changes to past disputes. A change to these Terms does not apply to a dispute that either of us gave notice of under Section 22.2 before the change was posted. Changes to Section 22 are also governed by Section 22.11.

18. Account Closure & Data Deletion

Canceling Your Subscription: You may cancel a paid subscription at any time from Settings → Billing. Cancellation takes effect at the end of your current billing period, after which your family account automatically moves to the Free plan. Your data is preserved.

Deleting Your Account: The account owner may permanently delete the family account at any time from the Settings page. Deletion is immediate and permanent: the family's personal and financial data is deleted from our active databases and cannot be recovered, any active subscription is canceled, and no refund is provided for any remaining paid period. Limited billing records (such as invoice history) may be retained where required for legal and tax compliance, and residual copies may persist in our infrastructure providers' backups for a limited period. Other limited records may remain as described in our Privacy Policy.

Termination by Us: We reserve the right to terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

19. Disclaimer of Warranties

Beyond Payday, including the website, apps, browser extension, calculators, embeds, Learning Center, Beth, and the AI connector, is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory. This includes implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment, and any warranties arising from a course of dealing or usage of trade.

In particular, we do not warrant that:

  • the service will be available, uninterrupted, timely, secure, or free of errors, bugs, or harmful code;
  • any calculation, projection, estimate, tax figure, import, category, or AI response will be accurate, complete, or reliable;
  • third-party data or services we rely on will be accurate or available; or
  • your data will never be lost or corrupted.

Some states do not allow certain warranties to be excluded, so some of these exclusions may not apply to you. In that case, those warranties last only as long as the law requires and are limited as much as the law allows.

20. Limitations of Liability

20.1 No indirect damages. To the maximum extent permitted by law, Beyond Payday and its members, managers, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. We are also not liable for lost profits, revenue, savings, or opportunities, tax penalties or interest, or loss of data, use, or goodwill. This applies even if we were told such damages were possible. It covers damages arising out of or related to:

  • the service or your use of or inability to use it;
  • any calculation, projection, estimate, or AI response, or any decision you made based on one;
  • errors, omissions, bugs, downtime, data loss, or security incidents;
  • the conduct of other users, professionals you share with, or third-party apps you connect.

20.2 Cap. To the maximum extent permitted by law, our total liability for all claims arising out of or relating to these Terms or the service will not exceed the greater of:

  • (a) the amount you (or, for a family account, the account owner) paid us for the service in the 12 months before the event giving rise to the claim; or
  • (b) one hundred U.S. dollars ($100).

This is the total for all claims combined, by you and the other members of your family account. It applies whatever the legal theory, whether contract, warranty, negligence, strict liability, or anything else.

20.3 Why these limits. These limits are a basic part of our agreement. They are why we can offer Beyond Payday free or at a low price. They apply even if a limited remedy fails of its essential purpose.

20.4 What these limits don't cover. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, or any rights you have under consumer protection laws that cannot be waived. Some states do not allow certain limits, so parts of this section may not apply to you.

21. Indemnification

You agree to defend, indemnify, and hold harmless Beyond Payday and its members, managers, employees, and agents from third-party claims, and from the resulting liabilities, damages, losses, fines, and reasonable costs (including reasonable attorneys' fees), arising out of:

  • (a) information you or the people you invite enter, import, or share, including information about other people;
  • (b) your violation of these Terms or of any law;
  • (c) your violation of anyone else's rights; or
  • (d) your misuse of the service, or misuse by anyone using your account or an app you connected.

We will tell you promptly about any such claim. We may control the defense, and you will cooperate. This section does not require you to pay our costs of defending a claim that you bring against us.

22. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS HOW DISPUTES ARE RESOLVED.

22.1 Governing law. Florida law governs these Terms and any dispute between you and us, without regard to conflict-of-law rules. The Federal Arbitration Act (9 U.S.C. § 1 and following) governs the interpretation and enforcement of this Section 22.

22.2 Step 1: Try to resolve it informally. Most problems can be fixed quickly, so before either of us starts arbitration or a court case, the one with the dispute must send the other a written Notice of Dispute.

  • Where to send it: you send yours to support@beyondpayday.com with the subject "Notice of Dispute", or by mail to HTMLGuy LLC, Attn: Legal, 7901 4th St N, Suite 300, St. Petersburg, FL 33702. We send ours to the email address on your account.
  • What it says: your name, the email address on your account, a description of the dispute, and the relief you want.
  • Who signs: it must be about you individually and be signed by you (not only by a lawyer).

For 60 days after the Notice is received, we will both try in good faith to resolve the dispute. Either of us may ask for an individual phone or video call during that time, and both sides will attend. Lawyers may join. Deadlines to bring a claim are paused during these 60 days. Neither of us may start arbitration or a court case (other than one described in Section 22.4) until this process is finished. If someone does, the arbitrator or court may pause or dismiss it until the process is complete.

22.3 Step 2: Binding individual arbitration. If we do not resolve the dispute within 60 days, any dispute, claim, or controversy between you and us will be resolved by binding individual arbitration, except as Section 22.4 provides. This covers claims arising out of or relating to these Terms, the service, your account, billing, marketing, or our relationship, whether based in contract, statute, tort, or anything else, and whether it arose before or after you accepted these Terms. The arbitrator decides all questions about whether a dispute must be arbitrated, including questions about the scope, validity, and enforceability of this Section 22. The exception is that a court decides questions about Sections 22.8 (individual claims only), 22.9 (mass filings), and 22.12 (severability).

22.4 What stays out of arbitration. Either of us may:

  • (a) bring an individual claim in small claims court in the county where you live or in Palm Beach County, Florida, if it qualifies and stays there;
  • (b) ask a court for an injunction or other equitable relief to stop infringement or misuse of intellectual property, or unauthorized access to the service or to other people's data; or
  • (c) bring a claim that the law says cannot be arbitrated, such as a request for public injunctive relief where the law does not allow it to be waived. Any such claim waits until the individual claims in arbitration are decided.

22.5 Rules and administrator.

  • Administrator and rules: the American Arbitration Association (AAA) administers the arbitration under its Consumer Arbitration Rules. Where they apply, its Mass Arbitration Supplementary Rules also apply. All of these rules are as modified by this Section 22 and are available at adr.org.
  • If AAA won't act: if AAA is unavailable or declines, JAMS will administer under its Streamlined Arbitration Rules and its Consumer Minimum Standards. If neither is available, a court will appoint an arbitrator under 9 U.S.C. § 5.
  • The arbitrator: there is one arbitrator, who must follow these Terms and the law, may award the same individual relief a court could, and will give a written decision.

22.6 Where and how. If your claim is for $25,000 or less, it will be decided on written submissions unless you ask for a hearing or the arbitrator decides one is needed. Any hearing will be by video or phone, or, if you prefer, in person in the county where you live. Judgment on the award may be entered in any court with jurisdiction.

22.7 Fees. If you start arbitration, you pay only the filing fee the AAA Consumer Rules require of consumers, and never more than the fee to file a lawsuit in court. We pay all other AAA and arbitrator fees. Each side pays its own lawyers' fees and costs, unless the arbitrator awards them under a law or AAA rule that allows it. If the arbitrator finds a claim was frivolous or brought for an improper purpose, fees are allocated as the AAA rules provide.

22.8 Individual claims only. No class actions. You and we may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may award relief only to the individual party asking for it, and only as much as that party's individual claim needs. In arbitration there is no judge or jury, and review of the award is limited.

22.9 Mass filings. This applies if 25 or more similar demands for arbitration are filed against us, or by us, by the same or coordinated lawyers or organizations. In that case:

  • (a) the AAA Mass Arbitration Supplementary Rules apply;
  • (b) the lawyers for each side will each choose up to 10 demands, 20 in total, to go forward first as test cases. The rest will be held and not filed or charged fees until the test cases are decided;
  • (c) after the test cases, both sides will mediate the remaining demands in good faith for at least 60 days, with AAA as mediator and our paying the mediator's fees;
  • (d) if mediation does not resolve them, the remaining demands go forward in batches of up to 100 per arbitrator, or as the AAA Mass Arbitration Supplementary Rules provide.

Deadlines for held demands are paused until each is allowed to go forward. If a court decides any part of this Section 22.9 cannot be enforced, the demands go forward under the AAA Mass Arbitration Supplementary Rules alone.

22.10 Your right to opt out. You may opt out of arbitration by sending us notice within 30 days after you first accept a version of these Terms that contains an arbitration agreement. If you already have an account, you get a fresh 30 days for version 1.21: you may opt out within 30 days after you accept it in the app or, if you have not accepted it by then, within 30 days after it takes effect (the date shown at the top of these Terms).

  • How: email support@beyondpayday.com with the subject "Arbitration Opt-Out", or mail it to the address in Section 22.2. Include your name, your account email, and a clear statement that you opt out of arbitration.
  • Effect: opting out does not affect any other part of these Terms. If you opt out, Section 22.13 applies to disputes between us.
  • Earlier opt-outs: if you opted out of an earlier version, that opt-out still applies.

22.11 Changes to this section. If we make a material change to this Section 22 (other than a change to a notice address), you may reject it by sending us notice as described in Section 22.10 within 30 days after the change is posted or we notify you, whichever is later. If you reject it, the version of Section 22 you last accepted continues to apply to disputes between us. No change to this Section 22 applies to a dispute either of us gave notice of before the change.

22.12 If part of this section can't be enforced.

  • If a court decides that Section 22.8 cannot be enforced for a particular claim or request for relief, that claim or request (and only that one) will be decided in court under Section 22.13. It will wait until the individual claims in arbitration are decided.
  • If any other part of Section 22 cannot be enforced, it is removed and the rest still applies.
  • If arbitration cannot be enforced for a dispute at all, that dispute will be decided in court under Section 22.13.

22.13 Courts. Any dispute that is not arbitrated will be decided only in the state courts located in Palm Beach County, Florida, or the United States District Court for the Southern District of Florida. This does not apply to a small-claims case under Section 22.4(a). You and we consent to the personal jurisdiction and venue of those courts.

22.14 Survival. This Section 22 survives the end of your account and of these Terms.

23. Miscellaneous

Entire Agreement: These terms, together with our Privacy Policy and any additional terms that apply to specific features or offers (such as the Partner Agreement or promo-code terms), make up the entire agreement between you and Beyond Payday regarding the service.

Severability: If any provision of these terms is found unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.

No Waiver: Our failure to enforce any provision of these terms is not a waiver of our right to enforce it later.

Assignment: You may not assign or transfer these terms. We may assign these terms in connection with a merger, acquisition, sale of assets, or by operation of law.

Survival: Sections that by their nature should survive termination of your account (including disclaimers, limitations of liability, indemnification, and governing law) survive.

Events beyond our control. We are not responsible for any delay or failure caused by events beyond our reasonable control. Examples are natural disasters, war, terrorism, pandemics, labor actions, government action, internet or power failures, cyberattacks, and failures of our hosting, database, email, payment, or AI providers.

Electronic notices. You agree that we may give you notices, disclosures, and agreements electronically, by email to your account address or in the app. Electronic notices satisfy any legal requirement that they be in writing. A notice we email is received when sent.

Independent parties. Nothing in these Terms creates a partnership, joint venture, employment, agency, or fiduciary relationship between you and us.

Apps and app stores. Our mobile apps, desktop apps and browser extensions are part of the service, and these Terms apply to them. If you download one from an app store, these Terms are between you and us, not the app store. If you got the app from Apple's App Store:

  • (a) Apple is not responsible for the app or its content, and has no duty to provide maintenance or support;
  • (b) to the extent any warranty applies under Section 19, Apple's only obligation, if the app fails to meet it, is to refund its purchase price (if any). Apple has no other warranty obligation;
  • (c) Apple is not responsible for any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, or intellectual property infringement claims. We, not Apple, handle those to the extent these Terms require;
  • (d) you confirm you are not in a country subject to U.S. government embargo or designated as "terrorist supporting", and are not on a U.S. government list of prohibited or restricted parties;
  • (e) you must also follow any applicable third-party terms (such as your wireless carrier's) when using the app; and
  • (f) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as to the app.

Apple's Usage Rules also apply. If you got the app from another app store, that store's terms also apply to your download, but these Terms govern your use of Beyond Payday.
