Effective Date: October 12, 2026
This Partner Agreement ("Agreement") is between HTMLGuy LLC, dba Beyond Payday (formerly PiggySize) ("Beyond Payday," "we," "us," or "our") and you ("Partner," or "you"). By signing up as a Beyond Payday Partner, you agree to the following terms:
1. Partner Benefits
- Recurring Commission: You will earn $2.00 USD per month for each user who signed up through your unique partner link and maintains an active, paid Pro Plan subscription, unless we agree a different rate with you in writing. Commission is subject to the Monthly Minimum in Section 2.
- Duration: Commissions are calculated while the referred user has an active, paid Pro Plan subscription and the Partner Program is operating, subject to this Agreement's termination terms.
- Rate changes: We may change commission rates, payout terms, or program tiers. A changed rate applies to all partners for qualifying referral activity after the change takes effect, except that any rate we agreed with you in writing is governed by that agreement. A rate change does not change commissions already earned.
2. Payout Terms
- Monthly Minimum: Commission is credited only for a calendar month in which that month's total reaches at least $10.00 USD (5 active, paying Pro Plan referrals at the standard rate). Months below $10.00 earn no commission, and amounts below the minimum do not carry over to later months.
- Active Requirement: Referral counts strictly exclude users on Free Plans or during their initial trial period, and are measured at the time each month is processed.
- Payment Method: Payments are made by a payout method we designate. After a qualifying commission is credited, we will arrange payment once you have provided or confirmed your payout details. Payment may be delayed while we obtain or verify those details.
- Schedule: We calculate and credit qualifying commissions monthly, generally within 15 days after the calendar month ends. Crediting a commission records the amount owed; it does not send the funds automatically.
- Taxes: You are responsible for taxes on your earnings. We may request tax information, including Form W-9, before payment and will provide any information return required by law.
3. Data Privacy & Transparency
- PII Protection: To protect our users' privacy, we mask personally identifiable information (PII). You may see that a user signed up (for example, jo***@example.com), but you will not see their full email or name unless they have authorized that disclosure.
- Tracking: We use cookies and shortcodes to track referrals. While we strive for 100% accuracy, we are not liable for tracking failures due to user settings (e.g., ad blockers, cleared cookies).
4. Liability & Termination
- Limits: See Section 8.
- Program Shutdown: We may shut down the Partner Program at any time. No new commissions accrue for referral activity after the shutdown date; commissions already credited remain subject to the payout terms above.
- Company Sale: In the event of a sale or acquisition, the buyer may decide whether to continue the Partner Program. Any commissions already credited remain subject to the payout terms above.
- Fraud and ineligible referrals: No commission is ever earned on a fraudulent or ineligible referral. This includes self-referrals, referrals of your own household or business, fake or duplicate accounts, accounts paid with stolen or disputed payment methods, cookie stuffing, incentivized sign-ups we have not approved in writing, and referrals obtained in violation of Section 5 or the law.
- We may withhold any commission while we investigate. If a referral's payment is refunded, charged back, or reversed, the commission for it is not earned.
- If we already paid a commission that was not earned, we may subtract it from future commissions, or you will repay it within 30 days of our request.
- We may end this Agreement immediately for fraud or a serious breach. Commissions already earned on legitimate referrals stay subject to the payout terms.
5. Marketing Conduct
- Disclose Your Connection: Whenever you promote Beyond Payday, you must clearly and conspicuously disclose that you are a paid Beyond Payday Partner who earns a commission (for example, "I'm a paid Beyond Payday partner"). The disclosure must be easy to notice and understand, and placed where your audience will actually see it, consistent with the Federal Trade Commission's Endorsement Guides (16 CFR Part 255).
- Truthful Claims Only: You may make only truthful, non-misleading statements about Beyond Payday, and only claims that are consistent with what Beyond Payday publishes on beyondpayday.com. Do not promise features, results, guarantees, or savings that Beyond Payday does not itself advertise.
- No Unsolicited Bulk Messaging: You may not send unsolicited bulk email or text messages to promote Beyond Payday. All email and SMS promotion must comply with the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and every other applicable law.
- Review and Correction: We may review your public promotions of Beyond Payday at any time, and may ask you to correct or remove any promotion that omits the disclosure above or makes a claim we do not publish. You must comply within five (5) business days of our notice. We may request written confirmation that your active promotions carry the required disclosure.
- Consequences: You are solely responsible for the content and manner of your promotions. Violations may result in termination of your Partner account. Commissions attributable to fraudulent or ineligible referrals may be withheld; other commissions already earned remain subject to the payout terms above.
6. Independent Contractor
- You are an independent contractor. Nothing in this Agreement makes you our employee, agent, partner, joint venturer, or franchisee.
- You may not make promises, sign anything, or speak for Beyond Payday. You also may not suggest that you are Beyond Payday or work for us.
- You decide how, when and where you promote Beyond Payday, within Section 5.
- You pay your own costs and taxes, and you are not eligible for any employee benefits.
- You may not say or suggest that Beyond Payday gives, or that you give on its behalf, financial, investment, tax, or legal advice.
7. Indemnity
You will defend, indemnify, and hold harmless Beyond Payday and its members, managers, employees, and agents from third-party claims and government inquiries, and from the resulting losses, fines, penalties, and reasonable legal fees, arising from:
- (a) your promotions, content, websites, and social media posts, including missing or inadequate disclosures under the FTC Endorsement Guides;
- (b) your emails, texts, or calls, including claims under the CAN-SPAM Act or the TCPA;
- (c) claims you make about Beyond Payday that we do not publish;
- (d) your breach of this Agreement or of any law; and
- (e) your infringement of anyone's rights.
We will tell you promptly about any such claim. We may control the defense, and you will cooperate.
8. Disclaimers and Limits
- As is. The Partner Program, your partner dashboard, referral tracking, and reports are provided "as is" and "as available," without warranties of any kind, to the maximum extent the law allows. Tracking may miss referrals (see Section 3). Our records decide which referrals and commissions qualify.
- No indirect damages. To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or opportunities. This includes lost commissions from tracking failures, program changes, or shutdown.
- Cap. To the maximum extent the law allows, our total liability for all claims arising out of or relating to this Agreement or the Partner Program is limited. It will not exceed the commissions you earned under this Agreement in the 12 months before the event giving rise to the claim (or $50, if that is more), plus any earned commissions we have not yet paid.
- What isn't limited. Nothing in this Agreement limits liability that the law does not allow to be limited.
9. Disputes
- Law. Florida law governs this Agreement, without regard to conflict-of-law rules. The Federal Arbitration Act governs the arbitration terms in this section.
- Talk first. Before starting any proceeding, the side with a dispute must send the other a written notice describing it and the relief wanted.
- Notices to us go to support@beyondpayday.com with the subject "Partner Legal Notice", or by mail to HTMLGuy LLC, Attn: Legal, 7901 4th St N, Suite 300, St. Petersburg, FL 33702.
- Notices to you go to your partner account email.
- Both sides will try in good faith to resolve it for 30 days. Either side may ask for a phone or video call.
- Deadlines to bring a claim are paused during those 30 days.
- Arbitration. If the dispute isn't resolved, it will be decided by binding arbitration.
- The arbitration is administered by the American Arbitration Association under its Commercial Arbitration Rules and their Expedited Procedures, before one arbitrator.
- It is held by video, or in person in Palm Beach County, Florida.
- Each side pays its own lawyers' fees. AAA and arbitrator fees are split equally, unless the arbitrator finds a claim or defense was frivolous.
- Judgment on the award may be entered in any court with jurisdiction.
- Individual claims only. Claims may be brought only individually, not in any class, collective, consolidated, or representative proceeding. If this sentence can't be enforced for a claim, that claim goes to court instead of arbitration.
- Exceptions. Either side may bring a qualifying claim in small claims court. Either side may also ask a court for an injunction to stop misuse of its trademarks, content, or confidential information, or unauthorized access.
- Courts. Any dispute not arbitrated will be decided only in the state courts in Palm Beach County, Florida, or the United States District Court for the Southern District of Florida, and both sides consent to their jurisdiction. EACH SIDE WAIVES TRIAL BY JURY.
- Your user account. If you also use Beyond Payday as a household, our Terms of Service govern disputes about that use.
10. Changes, Term and Termination
- Changes. We may update this Agreement. We will email you at least 30 days before a change that reduces your commissions or adds obligations takes effect, unless the change is required by law. Changes do not reduce commissions already earned. If you keep participating after the effective date, or accept the update in your dashboard, you accept the change. If you don't agree, you may end this Agreement before then.
- Ending it. You may end this Agreement at any time by emailing us or closing your partner account. We may end it with 30 days' notice, or immediately for fraud or a serious breach (Section 4).
- After it ends. When it ends you must stop promoting Beyond Payday as a partner and remove your partner links within 10 business days. Commissions earned on legitimate referrals before the end date stay subject to the payout terms, including the Monthly Minimum. Sections 3, 4 (Fraud), 6 through 9, and 11 survive.
11. General
- Trademarks. We give you a limited, revocable, non-transferable right to use the Beyond Payday name and logo only to promote Beyond Payday under this Agreement and our brand guidelines. You may not register or bid on domain names, social handles, or paid-search keywords containing "Beyond Payday" or "PiggySize" without our written permission.
- Assignment. You may not transfer this Agreement. We may transfer it to a successor in a merger, acquisition, or sale of our business.
- Entire agreement. This Agreement, plus any written rate agreement we sign with you, is the entire agreement about the Partner Program. If this Agreement conflicts with our Terms of Service about the Partner Program, this Agreement wins.
- Severability; no waiver. An unenforceable term is enforced as far as allowed, and the rest stays in force. Not enforcing a term is not a waiver.
- Notices. We may send notices to your partner account email. An email notice is received when sent.
